This competition is offered exclusively through the website lonelymountains.com and its creator Megagon Industries.

Participation is free of charge and does not obligate you to use or purchase any products or services. Megagon Industries is the sole contact and all enquiries should be addressed to Megagon Industries (for example, via contact form or e-mail).

§1 Comeptition procedure

1. Time frame

The competition takes place within a fixed time frame, which is clearly highlighted in the posting/Facebook post/Tweet describing and presenting the competition.

2. Type and implementation of the competition

The participant fullfils the task required in the contribution/facebook post/tweet. This may include: commenting or answering a question in the form of a comment under the post/facebook post/tweet on the contest description; answering a contest question that requires a correct answer and/or marking Lonely Mountains' Facebook page with "Like" or following Lonely Mountains' account on Twitter or Instagram at least for the duration of the contest.

3. Type and amount of the prizes

...are clearly listed in the post/facebook post/tweet describing and presenting the respective competition. Each participant in a competition can only win one prize per competition. Exchanges, collection and cash payment of the prize are not possible.

4. Determination of the profit

The winners will be determined after the closing date for entries in a random draw among all participants or, for example, by public voting. If the raffle is linked to a task, only those participants who have completed the task correctly will be entered into the selection/raffle.

5. Prize notification

The winners will be announced by Megagon Industries (Lonely Mountains) on the respective social media platform on which the competition has taken place after the end of the competition. Winners will be notified by personal message or, if applicable, by e-mail from Megagon Industries. If insufficient contact details (e.g. e-mail address) are available and contact cannot be established by Megagon Industries, the winners will have to contact Megagon Industries by e-mail to info[at]lonelymountains.com or by personal message on the social media platforms (Facebook/Twitter/Instagram) and will then be requested to provide their contact details.

6. Transmission of prizes

Megagon Industries will send the prize to the contact details provided by the respective winner by post / e-mail / download link. The shipment will take place as soon as possible after receipt of the contact data (e-mail address or, if applicable, postal address). Should the shipment be delayed, the winner will be informed in time.

 

§2 Participation

Participation in the competition requires agreement to the conditions of participation. By participating in the competition, the participant accepts these conditions of participation. Any natural person aged 18 years or older and resident in Europe is eligible to participate in the competition. Participation must be in their own name. Employees of Megagon Industries are excluded from participation in the competition.

Participation is only possible within the participation period. Entries received after the closing date will not be considered in the draw.

Only one submitted answer per participant will take part in the competition. It is strictly prohibited to use multiple email addresses or multiple Facebook profiles / Twitter accounts to increase the chances of winning.

Megagon Industries reserves the right to disqualify participants or exclude them from future participation in competitions without giving reasons. In particular in the event of a breach of these conditions of participation or if participants interfere with and/or manipulate the course of the competition in any way, in particular technical processes, or attempt to do so and/or otherwise unfairly attempt to influence the draw.

 

§3 Expiry of the prize

The prize will be forfeited if the winner is not contacted at the e-mail address he/she provided within 7 days, does not respond within 7 days of sending the prize notification or if the prize notification is undeliverable.

If the distribution of the prize is not possible because the notification fails and cannot be made up for within 28 days, the claim to the prize also expires.

 

§4 Data protection

To participate in the competition, personal data must be provided. Participants affirm that the personal details they provide, in particular first name, surname and e-mail address, are true and correct. The participants' data obtained in the course of the competition (name, e-mail address and, if applicable, postal address) will be used and processed exclusively for participation in the competition and in compliance with the statutory provisions. The data will not be passed on to third parties.

The participant agrees that his/her name may be published on the website of the lottery provider in the event of winning. This includes the announcement of the winner on the social media platforms of Megagon Industries (Lonely Mountains). In addition, the participant in the competition agrees that his/her name used via Facebook / Twitter (whether actual name or pseudonym) may be published on the Facebook page / in a Lonely Mountains tweet as part of the competition in the event of a win. Only the names of the winners will be displayed.

Otherwise, the usual data protection regulations apply.

The participant can revoke his/her declared consent by participating in the competition at any time. The revocation is to be sent in writing to the contact data (e-mail: info [at] lonelymountains.com) of Megagon Industries/ Lonely Mountains given in the imprint area. After revocation of the consent the collected and stored personal data of the participant will be deleted immediately. Further participation in the competition is then no longer possible.

 

§5 Licence rights granting

1.   The participant guarantees to be the owner of the necessary rights to the uploaded or linked photos/slogans/texts (following: content) etc. If the participant is not the sole author or rights holder, he/she expressly declares that he/she has the necessary rights to participate in the competition.

 

2.   The entrant grants Megagon Industries the following simple, non-exclusive rights of use, unlimited in time and space, to the content used by him/her:

•   the right to store the content on a server;
•   the right to make the content available to the public in whole or in part via the social media platforms used, such as Facebook/ Twitter/ Instagram and the website of Megagon Industries (in particular www.lonelymountains.com);
•   the right to use the content commercially and to advertise the products of Megagon Industries;
•   the right to edit the content, whereby photos may not be distorted.

 

4.   Megagon Industries shall, when using images, identify the author in a suitable manner, insofar as this is feasible in consideration of the specific form of use.
5.   By accepting the prize, the winner agrees that we may use his/her name for advertising purposes.

 

§6 Liability

The contributions or comments of the participants in the competition may not infringe the rights of third parties. Megagon Industries accepts no liability for any infringement of third party rights.

Megagon Industries reserves the right to terminate or modify the competition at any time without notice. This is particularly the case if this is necessary for legal or technical reasons and if proper execution can no longer be guaranteed. No claims against Megagon Industries can be derived from the termination or modification of the competition.

§7 Miscellaneous

The judges' decision is final.

The law of the Federal Republic of Germany shall apply exclusively.

Megagon Industries makes it clear that these Terms and Conditions of Participation and Privacy are subject to change at any time without notice.
